PIL against Vice President Dhankar, Law minister Rijiju for 'no faith' in Constitution
It said the VP and the law minister "insulted the Supreme Court using derogatory language". The petition pointed out remarks made by the two against the collegium system as well as the doctrine of basic structure and called it "unbecoming behaviour". The plea also made VP Jagdeep Dhankar and law minister Kiren Rijiju respondents.
The plea said that the two holding constitutional posts is "lowering the majesty of the Supreme Court in the eyes of the public".
The PIL further said the collegium system of appointment and transfer of judges evolved through various judgments of the Supreme Court. The apex court has also ruled that the collegium system of appointment of judges is part of the basic structure of the Constitution of India and is essential to maintain the independence of the judiciary.
Vouching for the collegium system, the petitioner further submits that one of the essential aspects of the theory of basic structure doctrine are 'Separation of Powers' and 'Independence of Judiciary'.
