#CBI: With Transfer of Case From Cyber Cell To CBI, Union Home Secretary Seeks Withdrawal of Plea From Mumbai Court

Days after transferring the cyber cell case, in which IPS officer Rashmi Shukla was allegedly involved, to CBI, the Union Home Secretary sought to withdraw the plea that was filed against Magistrate court order which had directed the Secretary to hand over documents and a pen drive to the Mumbai police.

Special Public Prosecutor Shreeram Shirsat representing the Union Home Secretary informed the court that the case was transferred to CBI from Cyber police station and thus the "revision may be disposed of." However, since there was no lawyer representing the cyber police in court at that time so the hearing was adjourned.

After the formation of the Maha Vikas Aghadi (MVA) government in Maharastra in 2019, the then opposition leader and now deputy chief minister Devendra Fadnavis had held a press conference alleging that there was corruption with regards to the transfer posting of senior police officers and that he had documents and a pen drive containing the call recordings of the phone conversations between people to show the same. He had gone to Delhi to hand over the pen drive and documents to Home Secretary seeking an investigation by a central agency.

Soon after, Mumbai police's cyber cell had registered a case under the officials' secrets act for leaking of sensitive official documents. Though the case was against unknown people, Shukla had approached the Bombay high court seeking protection from arrest. The cyber cell had recorded the statement of Shukla as well as Fadnavis in this case and it had also come to Esplanade Magistrate court seeking directions that the Home Secretary hand over the documents and pen drive.

While the Esplanade court ordered the Home Secretary to hand over the articles required, the Home Secretary went to Mumbai sessions court challenging that order.

However, with the change in government and the handing over of the case to the CBI, the Home Secretary has decided to withdraw the case in session court.
